Welcome to the website of Stella Polare Advisors, LLC - Series Stella Polare Travel d/b/a Stella Polare Travel ("Stella Polare Travel," "SPT," "we," "us," or "our"). These Website Terms of Use ("Terms") govern your access to and use of https://www.stellapolaretravel.com/ and any other website owned or operated by Stella Polare Travel that links to these Terms, including all pages, forms, content, comments, testimonials, submissions, and functionality available through those websites (collectively, the "Website").

By accessing or using the Website, submitting a form, signing up for our newsletter, submitting a comment or testimonial, or otherwise interacting with the Website, you agree to these Terms. If you do not agree, please do not use the Website.

These Terms apply only to Website use. They do not replace or modify any separate travel planning agreement, client agreement, trip proposal, invoice terms, supplier terms, booking terms, payment terms, cancellation terms, or Stella Polare Travel's separate travel terms and conditions that may apply to travel services.

1. Website Purpose

The Website provides general information about Stella Polare Travel, our travel planning services, travel inspiration, editorial content, inquiry options, newsletter signup opportunities, testimonials or comment features if enabled, and ways to contact us.

Nothing is purchased directly through the Website. Submitting a trip request form, contact form, newsletter signup, comment, testimonial, or other inquiry does not create a client relationship, guarantee availability, confirm travel arrangements, hold pricing, reserve services, or obligate Stella Polare Travel to provide services.

Any travel planning services, proposals, bookings, payments, or confirmed arrangements are governed by separate written terms, including applicable travel terms and conditions, supplier terms, payment terms, cancellation policies, and other documentation provided during the planning and booking process.

2. Relationship to Other Terms

These Terms govern public Website use. Stella Polare Travel's separate travel terms and conditions govern travel planning, booking, payment, cancellation, supplier relationships, and traveler obligations. The Privacy Policy governs the collection, use, disclosure, retention, and protection of personal information.

If there is a direct conflict between these Terms and Stella Polare Travel's separate travel terms and conditions regarding travel services, the separate travel terms and conditions control for those travel services. If there is a direct conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy controls for personal information practices. Supplier terms, trip-specific proposals, invoices, payment authorizations, confirmations, and written client agreements may also apply to specific travel arrangements.

3. Eligibility; Users Must Be 18+

The Website is intended only for individuals who are at least 18 years old. By using the Website, you certify that you are at least 18 years old.

If you are under 18, you may not use the Website, submit forms, sign up for communications, submit comments or testimonials, or use any of our online services.

Parents or legal guardians who are at least 18 years old may use the Website to inquire about travel involving minors, provided they have legal authority to do so and are responsible for all information submitted on behalf of those minors.

We do not knowingly collect personal information from anyone under 18 through the Website. If we learn that a person under 18 has submitted personal information through the Website, we may delete that information.

4. Changes to These Terms and the Website

We may update these Terms or change, suspend, or discontinue any part of the Website at any time. Changes are effective when posted on the Website or when notice is otherwise provided by a method we deem appropriate. Changes to these Website Terms apply to Website use. Changes to separate travel terms and conditions apply as stated in those separate terms or as otherwise agreed in writing.

You are responsible for reviewing these Terms periodically.

5. Website Content Is Informational Only

Website content is provided for general informational, editorial, and inspirational purposes only. Content may include destination descriptions, hotel or resort information, cruise or tour information, travel experiences, sample itineraries, editorial stories, journal entries, images, videos, articles, recommendations, testimonials, or other travel-related information.

Website content does not constitute a binding offer, professional advice, legal advice, financial advice, medical advice, safety advice, immigration advice, or a guarantee that any destination, property, supplier, itinerary, experience, promotion, price, availability, amenity, or service will be available, appropriate, safe, or suitable for you.

Travel information changes frequently. Website content is current only as of the date posted or last updated and may later become inaccurate, incomplete, or outdated. We may update Website content at any time but have no obligation to do so.

You are responsible for reviewing and complying with applicable passport, visa, entry, health, safety, documentation, and travel requirements. Official government, supplier, carrier, and destination sources should be consulted before travel.

6. No Client Relationship Created by Website Use

Using the Website, submitting an inquiry, completing a trip request form, signing up for a newsletter, submitting a comment or testimonial, or communicating through a contact form does not create a client relationship, fiduciary relationship, or advisor-client relationship with Stella Polare Travel.

A client relationship is established only when Stella Polare Travel expressly agrees to provide services and any required planning fee, agreement, proposal approval, deposit, payment authorization, or other onboarding requirement has been completed.

7. Trip Request Forms, Contact Forms, and Submissions

The Website may allow you to submit information through trip request forms, contact forms, newsletter signup forms, comment or testimonial features, or other inquiry forms. Some forms may be hosted or processed through third-party platforms, including Tern, Squarespace, TripSuite, TravelWits, Virtuoso, email marketing tools, payment processors, booking tools, supplier portals, or other service providers used by Stella Polare Travel.

By submitting information through the Website or a linked form, you represent that:

·       the information you provide is true, accurate, current, and complete to the best of your knowledge;

·       you have authority to provide any information submitted on behalf of another person;

·       you will not submit false, misleading, unlawful, infringing, offensive, harassing, defamatory, obscene, or harmful content;

·       you will not submit information that violates another person's privacy, intellectual property, contractual, publicity, or legal rights; and

·       you will promptly notify us if information you previously submitted materially changes.

You are responsible for the information you submit. We are not responsible for delays, errors, missed communications, inaccurate recommendations, or other issues caused by inaccurate, incomplete, outdated, or misleading information provided by you.

When submitting a trip request form, you may also be asked to agree to Stella Polare Travel's separate travel terms and conditions. Those separate travel terms and conditions govern travel planning and booking matters and control over these Website Terms to the extent there is a direct conflict regarding travel services.

8. Sensitive Information; Passport Information

You should not submit sensitive personal information through general Website forms unless we specifically request that information through an appropriate travel planning process. Sensitive information may include passport numbers, government identification numbers, financial account information, detailed medical information, medication information, disability information, dietary restrictions tied to medical or religious needs, information about minors, or other highly personal information.

Once a traveler becomes a client, Stella Polare Travel may request that the client upload passport copies or other travel documents through Tern, TripSuite or another secure third-party travel planning platform. This passport collection process is not completed directly through the public Website. It occurs through a separate client link or process provided as part of the travel planning relationship.

If sensitive information is needed for travel planning, we will request it through an appropriate process and handle it in accordance with our Privacy Policy, applicable law, and any applicable third-party platform terms.

9. Newsletter and Marketing Communications

The Website may allow you to sign up to receive newsletters, marketing emails, travel inspiration, updates, or other communications from Stella Polare Travel.

By submitting your name, email address, or other contact information for newsletter or marketing purposes, you consent to receive those communications from us. You may unsubscribe at any time by using the unsubscribe link included in our emails or by contacting us directly.

We may still send non-marketing communications related to an inquiry, request, client relationship, transaction, or service matter, where permitted by law.

10. Privacy Policy

By submitting a comment, testimonial, review, message, feedback, or other user-generated content, you grant Stella Polare Travel a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to post, edit, excerpt, exhibit, webcast, re-use, publish, reproduce, display, adapt, modify, create derivative works from, use, license, print, distribute, and otherwise use that content, in whole or in part, in all forms of media now known or later developed, without compensation to you.

This license includes the right to use attribution information you provide, such as your first name, initials, general location, or other identifying information you choose to submit with the content, subject to our Privacy Policy and applicable law. We may edit testimonials or comments for length, grammar, clarity, formatting, or style, provided we do not materially alter the meaning.

Stella Polare Travel is not responsible for messages, comments, testimonials, information, or materials uploaded, posted, distributed, submitted, or transmitted by users or other third parties.

We reserve the right, but have no obligation, to monitor, review, edit, delete, remove, refuse to post, or disable access to any third-party content that we deem objectionable, inappropriate, inaccurate, unlawful, infringing, defamatory, offensive, spam, promotional, in violation of these Terms, or otherwise unsuitable, for any reason or no reason.

We reserve the right to disclose information as necessary or appropriate to satisfy any law, regulation, subpoena, court order, governmental request, law enforcement request, legal process, or to protect the rights, property, safety, or security of Stella Polare Travel, our users, clients, service providers, or others.

12. Photographs and Videos

Stella Polare Travel reserves the right to use any photograph, video, or audiovisual recording taken at any event or during any travel activity, without the express written permission of those included within the photograph, video, or recording, to the maximum extent permitted by law and subject to any separate written agreement that expressly states otherwise.

Stella Polare Travel may use such photographs, videos, and recordings in publications or other media materials produced, used, or contracted by Stella Polare Travel, including without limitation websites, social media, newsletters, brochures, invitations, books, magazines, digital advertising, presentations, editorial content, promotional materials, and other media now known or later developed.

Any person who does not want their photograph, video, or likeness used by Stella Polare Travel should contact info@stellapolaretravel.com in writing and include a photograph or other reasonable identifying information so that we can make reasonable efforts to honor the request going forward. We cannot guarantee removal of materials already printed, distributed, published, shared, archived, or otherwise used before receipt and processing of the request.

13. Third-Party Platforms, Links, and Services

The Website may link to or integrate with third-party websites, forms, platforms, tools, booking systems, payment processors, email platforms, travel suppliers, social media platforms, or other third-party services. These may include, without limitation, Squarespace, Tern, TripSuite, TravelWits, Virtuoso, email marketing tools, hotels, resorts, cruise lines, tour operators, airlines, insurance providers, and social media platforms.

Third-party websites and services are not controlled by Stella Polare Travel. We are not responsible for the content, accuracy, availability, security, privacy practices, terms, policies, or actions of any third-party website, platform, supplier, or service.

Your use of third-party websites, platforms, or services is governed by the terms and privacy policies of those third parties. You should review those terms and policies before using them or submitting information through them.

14. Intellectual Property

The Website and its content include, without limitation, copyrighted materials, trademarks, service marks, trade names, logos, branding, trade dress, proprietary information, text, software, photos, videos, audiovisual recordings, graphics, music, sounds, designs, layouts, articles, journal entries, itineraries, guides, copy, icons, testimonials, and other materials.

The Website content, including the selection, coordination, arrangement, design, presentation, and enhancement of that content, is protected as a collective work under United States copyright laws and similar laws of other jurisdictions.

Stella Polare Travel owns or controls rights in content original to Stella Polare Travel and in the selection, coordination, arrangement, presentation, and enhancement of Website content. Third-party content providers, including travel suppliers, photographers, licensors, hotels, resorts, cruise lines, tour operators, destination partners, and other providers, may own rights in content original to them or licensed by them.

Some photographs, images, videos, destination content, property descriptions, supplier descriptions, logos, marks, or other materials appearing on the Website may be owned by or licensed from third parties. No rights are granted to you in any such third-party content except the limited right to view it on the Website for your own personal, non-commercial use.

You may access and view the Website for personal, non-commercial use only. You may not copy, reproduce, modify, distribute, publish, display, create derivative works from, sell, license, scrape, frame, mirror, download in bulk, transmit, or otherwise exploit Website content without prior written permission, except as permitted by applicable law.

All Stella Polare Travel names, logos, taglines, branding, and related marks are the property of Stella Polare Travel or its affiliated entities and may not be used without prior written permission.

17. Travel Suppliers and Availability

Stella Polare Travel may reference or work with independent travel suppliers, including hotels, resorts, cruise lines, tour operators, destination management companies, transportation providers, guides, insurance providers, and other travel-related businesses.

All travel suppliers are independent entities and are not employees, agents, partners, or joint venturers of Stella Polare Travel unless expressly stated otherwise in a separate written agreement.

References on the Website to destinations, properties, amenities, experiences, offers, inclusions, upgrades, pricing, availability, supplier images, supplier descriptions, or supplier services are for general informational purposes only and are subject to change without notice. Actual travel arrangements, if any, are governed by the applicable proposal, invoice, supplier terms, booking terms, and Stella Polare Travel's separate travel terms and conditions.

18. Security

You are responsible for using appropriate safeguards when accessing the Website, including secure networks, current browsers, and appropriate device security.

The public Website does not currently require users to create an account or password directly through the Website. If we later provide password-protected areas, registration features, client portals, or account functionality through the Website or a linked third-party platform, passwords are for individual use only. You may not share your password with anyone, and you are responsible for activity conducted through your account or credentials.

We reserve the right to investigate suspected violations of these Terms or system security and to cooperate with law enforcement, governmental authorities, courts, service providers, and security professionals where appropriate.

To the maximum extent permitted by law, you waive and hold harmless Stella Polare Travel from claims resulting from actions taken by Stella Polare Travel during or as a result of its investigations, or from actions taken as a consequence of investigations by Stella Polare Travel, law enforcement authorities, government authorities, courts, service providers, or security professionals.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER, PLATFORM, OR THIRD-PARTY SERVICES THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING THE USE, ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR RESULTS OF USE OF THE WEBSITE OR WEBSITE CONTENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, STELLA POLARE TRAVEL AND ITS OWNERS, OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AFFILIATES, SERVICE PROVIDERS, SUPPLIERS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COMPUTER DAMAGE, SECURITY BREACHES, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE WEBSITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STELLA POLARE TRAVEL'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID DIRECTLY TO STELLA POLARE TRAVEL THROUGH THE WEBSITE FOR THE SERVICE GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER. Because nothing is purchased directly through the Website, this amount will generally be $100 unless otherwise required by law.

The limitations above apply whether a claim is based in contract, tort, negligence, strict liability, statute, or any other legal theory, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

22. Limitation Period for Website-Related Claims

To the maximum extent permitted by law, any claim, action, or proceeding arising out of or relating to the Website or these Terms must be brought no later than the earlier of: (a) the applicable statute of limitations; or (b) two years after the claim accrues. This section does not revive any claim that is already barred by applicable law.

24. Jury Trial Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND STELLA POLARE TRAVEL KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY CLAIM, ACTION, OR PROCEEDING ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS.

25. Indemnification

You agree to defend, indemnify, and hold harmless Stella Polare Travel and its owners, officers, members, managers, employees, contractors, representatives, affiliates, service providers, suppliers, licensors, and agents from and against any claims, demands, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • your violation of these Terms;

  • your violation of applicable law;

  • your violation of the rights of another person or entity;

  • information, comments, testimonials, photos, videos, content, or materials you submit through or in connection with the Website;

  • your reliance on comments, testimonials, or content submitted by others;

  • your fraud, misrepresentation, negligence, or willful misconduct.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

We make no representation that the Website, Website content, services, forms, or communications are appropriate or available in every jurisdiction.

These Terms and any dispute arising out of or relating to the Website or these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

30. Venue and Courts-Only Dispute Resolution

You agree that any claim, action, or proceeding arising out of or relating to the Website or these Terms will be brought exclusively in the state or federal courts located in Dallas County, Texas, unless applicable law requires otherwise.

You consent to the personal jurisdiction of those courts and waive any objection to venue, inconvenience of forum, or lack of personal jurisdiction in those courts.

These Terms do not require arbitration. The parties agree to resolve disputes through the courts identified above, subject to any applicable jurisdictional requirements.

31. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The invalid, unlawful, or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable, or, if modification is not possible, will be severed from these Terms.

32. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Stella Polare Travel.

33. Entire Agreement for Website Use

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stella Polare Travel regarding Website use.

These Terms do not replace any separate agreement, proposal, invoice, supplier terms, booking terms, payment terms, cancellation terms, travel terms and conditions, or other documentation that may apply to travel services.
